Abstract/Objectives
The purpose of this course is to examine the history, development, structure of international human rights law and its impact on the domestic level, particularly in Taiwan. In this course, the students will investigate the historical background and legal framework of the United Nations and its related core human rights instruments and institutions. Those human rights instruments are the International Covenant on Civil and Political Rights (ICCPR) and the International Covenant on Economic, Social and Cultural Rights (ICESCR), the Convention on Elimination of All Forms of Discrimination against Women (CEDAW), the Convention on the Rights of the Child (CRC), and the Convention on the Rights of Persons with Disabilities (CRPD). Besides, Taiwan has been witnessed to make much progress in incorporating international human rights laws into its domestic legal system in recent years. For example, Taiwan made its first declaration of full voluntary compliance with the CRC in 1993, followed by subsequent domestic legislative revisions. In 2007, the government ratified the CEDAW and issued its first state report two years later. Most significant of this was the ratification of the ICCPR and the ICESCR in 2009. In the same year, the Legislative Yuan of Taiwan passed the Implementation Act to make the guaranteed rights in two covenants directly applicable in the Taiwanese legal system. Most recently, the Legislative Yuan enacted the Implementation Acts of the CRC and the CRPD in June 2014 and August 2014 respectively. Against this backdrop, students are also required to study how those core international human rights instruments shape the landscape of the Taiwanese legal system. In addition, emerging issues such as climate change, artificial intelligence, and global health crisis also will be analyzed through the lens of international human rights law.
