Abstract/Objectives

National Tsing Hua University has developed an internal reporting system focused on gender equality and the prevention of gender-related incidents. Key measures include the confidentiality of the identities of whistleblowers and parties involved in reports of harassment, with exceptions made only for legal or safety reasons. Protective measures are to be offered to whistleblowers facing potential harm. When investigating gender-related incidents, the university ensures privacy and confidentiality, demanding that all personnel involved maintain discretion regarding the identities of those affected. Regulatory provisions also outline the principles for handling sexual harassment cases, emphasizing non-public investigations to safeguard personal rights. Additional resources, including guidelines for an Employee Complaint Review Committee, are provided for staff-related issues at the university. 3. Regulations for Preventing Gender-Related Incidents on Campus at National Tsing Hua University

Article 17: When reporting in accordance with Article 8, Paragraph 1 of the university's gender equality implementation measures, the names of the parties involved and the whistleblower, or other information sufficient to identify their identity, shall be kept confidential, except where necessary for investigation, based on public safety considerations, or as otherwise specifically provided by law.

Article 24: When the university investigates campus gender incidents, it shall handle the matter as follows: (4) The names and any other identifying information of the perpetrator, the victim, the whistleblower, or persons invited to assist with the investigation should be kept confidential. However, this confidentiality does not apply where necessary for investigation or based on considerations of public safety.

Article 25: Those who are obligated to maintain confidentiality as per the preceding article, Paragraph 5 include all personnel involved in handling campus gender incidents. If anyone who is obligated to maintain confidentiality divulges information, they shall be punished according to criminal law or other relevant regulations. The university shall seal the original documents containing the names of the parties involved, whistleblowers, and witnesses, and they must not be made available for review or provided to anyone outside of investigation or judicial authorities. However, this does not apply where otherwise provided by law. Apart from the original documents, any documents prepared separately by personnel handling campus gender incidents for external use should have the real names and other identifying information of the parties involved, whistleblowers, and witnesses removed and replaced with codes.

Article 8: In investigating sexual harassment incidents, the investigation should be conducted according to the following principles:

1. Investigations of sexual harassment incidents should be conducted in a non-public manner, ensuring the privacy and legal rights of the parties involved.

7. All personnel handling sexual harassment incidents must keep the names of the parties involved or other identifying information confidential, except where necessary for investigation or based on public safety considerations.
